Fightin’ Words: Robert Earl Keen v. Toby Keith

When TEXAS MONTHLY talked to Robert Earl Keen about his new album last fall, the Bandera songwriter was relatively coy about the song “The Road Goes On and On,” which appears to be directed at Toby Keith, whose 2010 hit “Bullets in the Gun” sounds pretty similiar to Keen’s eternal (and oft-covered) classic “The Road Goes on Forever,” both melodically and lyrically.

Among some of Keen’s lyrics from “The Road Goes On and On” include:

You’re a regular jack in the box
In your clown suit and your goldilocks
The original liar’s paradox (you’ll have to Google that) . . .

And:

Your horse is drunk and your friends got tired
Your aim grew weak and uninspired . . .

(An obvious reference to Keith’s song with Willie Nelson, “Beer for My Horses.”)

In the interview with Jeff McCord, Keen acknowledged that the song was about Keith, but said:

Well, it’s kind of difficult to talk about, you know? I felt like this individual had been picking on me for a long time, and I was sick of it. So instead of getting really ugly about things—I don’t really believe in lawsuits or threats—I took the Alexander Pope road and answered this guy in song. We’ll just have to see what happens.

Now Keen is out on tour, with a date in Wilmington, North Carolina, and Mike Voorheis of the Wilmington Star-News got him to be a bit more blunt about it:

It’s not exactly 50 Cent vs. The Game, but Keen, who will play the Brooklyn Arts Center on Wednesday, Feb. 1, pulls no punches when he talks about Keith. Keen believes Keith stole the melody from his song “Road Goes on Forever” for Keith’s 2010 tune “Bullets in the Gun.” As soon as Keith’s song was released, Keen’s fans rose up in protest.

I got all these calls from my friends. They were saying, ‘This is ridiculous. What are you gonna do?’” Keen said during a phone interview last week.

So Keen responded the best way he knew. He wrote a song.

In “The Road Goes On and On,” he doesn’t mention Keith by name but he refers to his “goldilocks” and says his “horse is drunk and your friends got tired.” In the song, he calls Keith a fraud and sings, “I never liked you anyway.”

When asked if “The Road Goes On and On” was written for Toby Keith, Keen cleverly turns the question.

I didn’t write it for him to sing it, I can tell you that,” he said.

And did it make him feel better?

Absolutely,” Keen said. “I did feel like I had to say something. I had to do something.”

Keen also told Voorheis that Nashville’s biggest stars feel like they can “borrow and steal and bully people around. I hate it.”

To the guys who keep saying they sound nothing alike. You have to skip forward in the REK video, the first song is not the song that Keith copied. If you listen to “the road goes on forever” and then listen to “bullets in the gun”. You can hear that Toby is singing a song identical to the song that REK wrote. It happens all the time, but this time it was more than obvious.
Pretty fishy: melody’s the same, even some of the lyrics are identical. It’s pretty obvious, and anybody that can’t see that is so far up Toby’s butt they can smell the dixie chicks.. I really like them both, would rather see REK if you gave me a choice, but this is a little over the top..
Wow it is clear that this is a direct rip-off. It’s a shame that the Daily Post didn’t post a video of just “the road goes on forever.” By starting the above video with “the road goes on and on” I wonder if many people watch the video long enough to get to “the road goes on forever.” This makes me wonder what are the intentions of the Daily Post. Whether TK purposely ripped Keen’s song off or was just listening to a lot of Keen’s music at the time and subconsciously wrote “bullets in the gun” it’s way too close to Keen’s song. TK needs to man up and give the credit and a nod to Keen and maybe a royalty cheque or two. Keen is great song writer and I hope that his soul is paid kindly for the great music that he writes. I’m having a nice cold beer in a bottle right now, so here’s to you Robert Earle Keen and the great music you have created and continue to create.
I don’t know REK nor do I wish to hear his music because he has a lousy following of jealous people who have nothing better to do than bash TK. Hmmmmm, you think TK is a thief, jerk, whatever? Obviously you know NOTHING about Toby. Check out all the money spent on pills for children with cancer so they NEVER have to feel the effects of Chemo, check out the ranch built to keep family together who are suffering from disease. Also, check out how his father was killed. You guys sit here and condemn a man who is a genius, great to his fans, family and so on. He is rich, does not need to steal a song and has the approval of a zillion fans who all go to his concerts over and over again because Toby is the real deal, he is very loved and respected. As for red solo cup, hell I tried for months to find one on the shelves, I got a bunch of them! And look at that song, he has the ones who wrote it ON STAGE WITH HIM not stealing it. Get a grip, Toby did not steal that song. As for the dixie chicks, they are nothing now as well. Hmmmmm, I guess you guys are WAY outnumbered and wrong. Never will listen to anything from REK thanks mainly to you guys here! He must be proud of yas
LMAO, Really? Do you think this childish act of insecurity is going to bother Toby Keith? LOL When your bank account can exceed his then make your statements. Toby stays true to himself and tells it like it is. But, I don’t think I would want to EVER be on Toby’s bad side, he’ll chew you up, spit you out and serve you up in a RED SOLO CUP!
What would the size of his bank account have to do with the his plagiarizing , on second thought, I suppose it could. He obviously ripped Keen’s song off, if he is such a big man, why hasn’t he just manned up and apologized?

Keen is perhaps one of the most talented, original artists working today. Keith is probably one of the most manufactured major-labor singers working today. Keen should sue; he’d win.
Both of them are musical hacks.
Toby Kieth has class? Really. Toby Keith is the Brittney Spears of Country Music. REK is is an original, not to mention a regular guy, who has been true to his craft as a songwriter for several decades.
I have great respect for Toby Keith, I have never heard him diss any of his fellow muscians. I think he has a great deal of class, love his music and will continue to support him. His latest album is one of the best.

I never hear of this guy Robert Earl Keen Jr. he should stay in Texas. What I hear is music going on and on I did not like didn’t hear any similarities. Toby Keith has put life back into a song earned his fame with pure talent and creativity. The SOONER is a good team and I am in Maryland. The Red Solo Cup with Wild Shot in it is O so good. Them about TRASH O by you have not seen yet!!! Toby Keith is a packaged all in one. Mr. Keith since the days of putting a boot in someone’s ass via “Courtesy of the Red, White and Blue” and Dixie Chicks stunt GOOD for him USA should of put a BOOT up there a long time ago. I watch The Dixie Chicks I use to like them but what was say about Mr.P was wrong to say, and Toby was right to do what he did she lie about the T-Shirt she was wearing. I didn’t hear the similarities. Maybe it’s because one is a nice sounding studio recording an the other is live. That being said, who cares? They both suck. Wonder why Texas music is in such bad shape? The mags and papers just report in bad crap like REK as if that is the only style played here. Keen music is for drunk yuppies that are waiting for Jimmy Buffet to come to town.
Mr. Keen is an uniquely talented individual who writes the perfect Texas song - it tells a story, it’s good for dancing, it’s a beer drinking song. Toby Keith is not unique. He’s dressed up by Madison Avenue like the rest of the clones and does not perform without benefit of auto tune. Robert Earl earned his fame with pure talent and creativity. Toby Keith was packaged and marketed, probably based on the results of focus groups.
What do you expect… he’s a sooner d-bag. If it’s anyone that knows how to steal, it’s gonna be a sooner.
I’ve had a strong dislike for Mr. Keith since the days of putting a boot in someone’s ass via “Courtesy of the Red, White and Blue” and for his little Dixie Chicks stunt… I’ve never considered him much in the way of talent anyway, he’s more of the arena-country-pop that has led many Texas Country music fans to develop a distate for a lot of what Nashville produces. Lifting a song off REK, while not necessarily a surprising move from Keith, just cements the fact that he is a total tool. I think it speaks highly of REK, while also not a surprise, that he took the high road. I do not have the same expectation of ol’ Toby in his reaction, but I guess we’ll see. Now how about that boot in your ass, sir?

This is crazy!! I listened to both songs ( Toby’s and REK’s) they are nothing alike. The melody, lyrics…nothing!!!

Wow. Remarkably obvious lift…story line, melody, lyrics. Hell, he should have just covered “The Road Goes on Forever.” What a low life artistic fraud. Handled properly though REK.

REK is not jealous of Keith at all. REK is pure Texan through and through. And if you are a real Texan, you’d rather hear him than Keith any day. As for selling records, remember this, awards and numbers and such are for people who need the adulation. REK has what TK will never have, real Texas fans and real talent. TK is just a carbon copy of everything that is coming out of Nashville these days. Those people wouldn’t know real country music if it hit them in the face, and neither do their fans! I’ll go on listening to REK and you can have your red solo cups and his crappy music.
I’m glad Texas had REK, because he needs Texas. However Toby seems to reach a lot more than just “Texas” , so I don’t think anything REK has to say will phase him at all !!! Toby’s as much country music as REK, he just delivers it better!!!!! Also, REK is obviously looking for some kind of “adulation” to be whimpering over something Toby didn’t do ( geez, why would Toby need to steal from REK after all he as accomplished)! Both songs are a story about love, stealing, drinking etc…… isn’t that most country music!

As a fan of music I can see both sides of the issue. As a purist I will most definitely lend my favor to REK. I must admit TK’s songs chord progressions, melody, lyrics and even content lean heavily on REK’s song. While there is a lot of adulation (and you can google that ;) for both, I have found more raw talent in REK hands down. This is a man who worked his way to get every cent he’s made and every note that he plays. As for the red solo cup deal…. Really? I’ll take my beer as the fine folks at the brewery intended it to be… In a bottle. I know that my trunk is full of shiner bock and lone star ;). So, here’s to real, genuine, non-overproduced or corporately influenced music!! Play on REK and never get a professionally man-scaped beard!
